Client Services Agreement
Effective Date: January 1, 2026
This Client Services Agreement (“Agreement”) governs the professional relationship between Oak & Owl (“Provider”) and the individual or entity purchasing or participating in services (“Client”). By scheduling or purchasing services, the Client acknowledges that they have read, understood, and agree to the terms of this Agreement.
1. NATURE OF SERVICES
Oak & Owl provides structured discernment services grounded in philosophical and ethical reflection. Services are educational and consultative in nature and are intended to assist clients in clarifying complex decisions, identifying relevant values and responsibilities, and considering possible paths forward. Sessions are conducted virtually and are time-bounded.
2. SCOPE OF SERVICES DISCLAIMER
Services provided by Oak & Owl are not psychotherapy, mental health treatment, counseling, medical care, legal advice, financial advising, or crisis intervention. Oak & Owl does not diagnose or treat mental health conditions and does not provide regulated professional services. Clients should consult appropriately licensed professionals for matters requiring such expertise.
3. INFORMED CONSENT
By engaging in services, the Client acknowledges that the discernment process involves reflective conversation intended to clarify perspectives and support thoughtful decision-making. The Client understands that the Provider facilitates structured reflection but does not prescribe decisions or determine outcomes.
4. CLIENT RESPONSIBILITY
The Client acknowledges that Oak & Owl provides a structured discernment process intended to support reflection and thoughtful decision-making. The Provider does not direct, prescribe, or make decisions on behalf of the Client. All personal, professional, financial, relational, or other decisions made before, during, or after participation in services remain solely the responsibility of the Client.
5. STRUCTURE OF ENGAGEMENT
Sessions are scheduled in advance and conducted virtually using video conferencing technology. Engagements are structured and time-bounded. Oak & Owl does not provide on-demand availability, crisis services, or unlimited ongoing access outside scheduled sessions.
6. FEES AND PAYMENT
Fees for services are presented at the time of booking. Payment is required in advance unless otherwise agreed in writing. Payments are processed through third-party payment processors.
7. REFUND & TERMINATION POLICY
Refunds and Terminations are governed by the Oak & Owl Refund & Termination Policy, which is incorporated by reference into this Agreement. Clients are encouraged to review the Refund & Termination Policy prior to purchasing services.
8. CONFIDENTIALITY
Information shared during sessions will be treated with professional discretion. However, communications may occur through third-party technologies such as video conferencing platforms and email, which cannot be guaranteed to be completely secure.
9. TECHNOLOGY AND VIRTUAL SERVICES
Services are delivered through electronic communication platforms. The Client acknowledges that technological disruptions, connectivity issues, or platform limitations may occasionally occur.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Oak & Owl shall not be liable for indirect, incidental, consequential, or special damages arising from participation in services. Total liability for any claim related to services shall not exceed the amount paid by the Client for those services.
11. NO GUARANTEE OF OUTCOMES
Oak & Owl provides a structured discernment process intended to support thoughtful reflection. Outcomes depend on numerous factors outside the control of Oak & Owl, including the Client’s choices and circumstances. Accordingly, Oak & Owl does not guarantee any specific results.
12. ELECTRONIC AGREEMENT
By scheduling or purchasing services through the Oak & Owl website or booking platform, the Client acknowledges that they have read and agreed to this Agreement and related policies. Electronic agreement and confirmations shall be considered legally binding.
13. DISPUTE RESOLUTION
In the event of a dispute arising from services, the parties agree to attempt good-faith resolution through direct communication before pursuing formal legal action.
14. MEDIATION
If a dispute cannot be resolved through direct communication, the parties agree to first attempt to resolve the dispute through non-binding mediation conducted in the Commonwealth of Massachusetts before initiating litigation.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Client and Oak & Owl regarding services and supersedes any prior communications or understandings.
16. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. MODIFICATIONS
Oak & Owl reserves the right to update or modify this Agreement from time to time. The most current version will be posted on the website with a revised effective date.
18. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts.
